If a product is not as described, your sole remedy is to return it in accordance with our Refund and Return Policy.

If a product you ordered is not available, we will notify you and either offer a substitute (with your consent) or cancel your order and issue a full refund.

Pricing and Payment

Prices

All prices are listed in U.S. Dollars (USD) and are subject to change without notice. However, price changes will not affect orders that have already been confirmed.

Payment Terms

  • Payment is due at the time you place your order.
  • For pre-sale orders, a deposit of $7.00 USD is charged immediately upon order placement. The remaining balance will be charged when your order is fulfilled and prepared for shipment.
  • We accept payment via Shopify Payments and PayPal.
  • By providing payment information, you authorize us to charge the applicable fees to your payment method.

Taxes

You are responsible for all applicable sales taxes, VAT, duties, and other governmental charges (collectively, "Taxes") associated with your purchase. We will collect applicable sales tax for orders shipped to U.S. states where we have a tax obligation.

Promotional Codes and Discounts

We may offer promotional codes, discount codes, or other special offers from time to time. The following terms apply to all promotional codes and discounts:

  • Promotional codes are valid only for the time period and products specified in the promotion.
  • Promotional codes cannot be combined with other offers unless explicitly stated.
  • Promotional codes are intended for single use per customer unless otherwise specified.
  • Promotional codes have no cash value and cannot be redeemed for cash.

  • Promotional codes may not apply to shipping costs, taxes, or subscription renewals unless explicitly stated.
  • If you return products purchased with a promotional code, your refund will reflect the actual amount paid, not the original price.

Abuse or misuse of promotional codes may result in account suspension or termination.

Orders and Order Acceptance

When you place an order, you will receive an order confirmation email. This email confirms that we have received your order but does not constitute our acceptance of your order.

We reserve the right to accept or reject your order for any reason, including but not limited to product availability, errors in pricing or product information, suspected fraudulent activity, or failure to meet eligibility requirements.

Your order is accepted, and a binding contract is formed, when we ship your order and send you a shipping confirmation email.

Shipping and Delivery

Shipping Locations

We currently ship only within the United States. We ship to all 50 U.S. states.

Shipping Times

Standard shipping typically takes 1-5 business days after your order has been processed and shipped. Delivery times may vary depending on your location and shipping carrier.

We are not responsible for delays caused by shipping carriers, customs, weather, or other events beyond our control.

Risk of Loss

All products are shipped from our U.S. warehouse. Risk of loss passes to you upon delivery to your specified address.

Shipping costs are calculated at checkout and vary based on your location and order size.

Subscription Services

Subscription Terms

We offer subscription services for automatic recurring deliveries of our products on a monthly basis. When you subscribe:

  • You authorize us to charge your payment method automatically at the start of each billing cycle.
  • Your subscription will continue until you cancel it.
  • Subscription pricing and terms will be clearly disclosed at the time of signup.

Cancellation and Changes

You may cancel or modify your subscription at any time by logging into your account or contacting us at info@millysbest.com. To avoid charges for the next billing cycle, you must cancel at least 48 hours before your next scheduled shipment date.

Once a subscription order has been processed and shipped, it cannot be canceled or refunded. Please refer to our Refund and Return Policy for information on returning products.

Price Changes

We reserve the right to change subscription pricing with at least 30 days' advance notice. You will have the opportunity to cancel your subscription if you do not agree to the new pricing.

WE DO NOT WARRANT THAT:

  • The Services will be uninterrupted, secure, or error-free.
  • The results obtained from using the Services will be accurate or reliable.
  • Any errors in the Services will be corrected.


Baking Results

While we provide instructions and guidance, we cannot guarantee specific baking results. Baking success depends on many factors, including following instructions, ingredient quality, environmental conditions, and individual technique. We are not liable for unsuccessful baking attempts except as provided under our Money Back Guarantee.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, XANTUS PRODUCTS LLC, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR $100 USD, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, so some of the above limitations may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless Xantus Products LLC and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your violation of any third-party rights
  • Your User Content

Force Majeure

We shall not be liable for any failure or delay in performance of our obligations under these Terms due to events beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, pandemics, labor disputes, strikes, supplier failures, transportation delays, government restrictions, power outages, or interruptions in telecommunications or internet services.

In the event of a force majeure situation, we will make reasonable efforts to notify affected customers and resume normal operations as soon as practicable.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles.


Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with the AAA Consumer Arbitration Rules. The arbitration shall take place in Wilmington, Delaware, or at the consumer's option, by telephone or videoconference. Either party may seek injunctive or equitable relief in a court of competent jurisdiction.

You and Xantus Products LLC agree to waive any right to a jury trial.

Class Action Waiver

You agree that any arbitration or legal proceeding shall be conducted on an individual basis and not as a class action, consolidated action, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Modifications to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by posting the updated Terms on the Site and updating the "Last updated" date. Your continued use of the Services after such changes constitutes your acceptance of the modified Terms.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.


Entire Agreement

These Terms, together with our Privacy Policy and Refund and Return Policy, constitute the entire agreement between you and Xantus Products LLC regarding the Services and supersede all prior agreements and understandings.
